Data & Account Deletion Policy
Your rights to request deletion of your personal data and how Business Hero processes those requests.
Last Updated: May 1, 2025
1. Your Right to Request Deletion
Under the California Consumer Privacy Act (CCPA) and applicable privacy law, you have the right to request that Business Hero delete the personal information we hold about you, subject to certain exceptions described in this policy.
This right applies to:
- Your account profile and registration data
- Documents you have uploaded to the Platform
- Communications sent through the Platform's messaging system
- Intake form submissions and matter details
2. How to Submit a Deletion Request
You may submit a data deletion request through any of the following methods:
- Email: Send a request to info@mybusiness-hero.com with the subject line "Data Deletion Request"
- Client Portal: Navigate to Account Settings and select "Request Account Deletion"
- Written Request: Mail a written request to Business Hero, Inc., 660 S Figueroa St, Suite 2250, Los Angeles, CA 90017
To protect your privacy, we will verify your identity before processing any deletion request. You will be asked to confirm your email address and may be asked to provide additional verification.
3. Processing Timeline
We will acknowledge your deletion request within 5 business days of receipt. We will complete the deletion or provide a substantive response within 30 calendar days of verification, as required by California law. If we need additional time (up to 60 additional days), we will notify you and explain the reason for the extension.
4. What We Will Delete
Upon a verified deletion request, we will delete or anonymize the following where not subject to a retention exception:
- Your account profile, login credentials, and personal contact information
- Documents and files uploaded to your account that are not part of a retained legal matter file
- Marketing preferences and communication history
- Device and browser information collected through cookies and analytics
5. What We May Retain (Exceptions)
- Legal Matter Records: Documents, communications, and data related to active or completed legal matters must be retained for a minimum of 5 years to comply with attorney professional conduct rules and statute of limitations considerations
- Financial Records: Transaction history, invoices, and payment records must be retained for 7 years for tax and accounting compliance
- Legal Hold Data: Any data subject to an active legal hold related to litigation or regulatory investigation cannot be deleted until the hold is lifted
- Fraud Prevention: Records necessary to prevent fraud or protect the security of the Platform
- Regulatory Compliance: Data required to be retained under applicable federal, state, or professional regulations
- Aggregated/Anonymized Data: Data that has been fully anonymized such that it cannot be linked back to you may be retained for analytics purposes
We will inform you specifically which data we are retaining and the legal basis for each retention, at the time we respond to your request.
6. Account Closure vs. Data Deletion
Closing your account and deleting your data are two separate actions:
- Account Closure terminates your access to the Platform and cancels your subscription. Your data remains in our systems subject to standard retention schedules.
- Data Deletion Request initiates the formal process to delete your personal information, subject to the exceptions in Section 5. You may request data deletion at account closure or at any time.
Submitting a data deletion request automatically initiates account closure if your account is still active.
7. Impact of Deletion on Active Matters
If you have an active legal matter at the time of your deletion request:
- The assigned attorney will be notified that you have requested to terminate the engagement
- Matter data required for the attorney to close out the representation will be retained for the applicable retention period
- You are responsible for obtaining alternative legal counsel if your matter requires ongoing representation
- Fees paid for services already rendered are generally non-refundable
We strongly recommend resolving any active legal matters before submitting an account deletion request.
8. Third-Party Data
Your deletion request covers data held by Business Hero. We cannot control data held by independent attorneys (who maintain their own client file obligations under bar rules), or data held by third-party service providers under their own retention obligations. Upon request, we will notify relevant third parties of your deletion request where we are legally permitted to do so.
9. Non-Discrimination
Exercising your data deletion rights will not result in any discrimination, denial of service, or different pricing from Business Hero. However, if deletion of certain data makes it technically impossible to provide a specific service, that service may no longer be available to you.
